Australian women are allowed to file a case against Qatar Airways.
According to the World News Agency, five Australian women claimed that in 2020 they were forcibly discovered by armed guards at Doha Airport and discovered their clothes and forcibly conducted a medical examination.
Five of the affected women filed a lawsuit in Australia in 2022 against Qatar Airways, airport operator “peas” and Qatar’s Civil Aviation Authority.
He prescribed responsibility on the basis of abuses during the aircraft journey under the “Montreal Convention”, as well as allegations of negligence, attacks and illegal custody.
The affected women claimed that they suffered with them a non -physical physical examination as a result of severe mental stress, depression and post -tramy stress disorder.
Last year, Justice John Haley of the federal court dismissed the case and said there is no real possibility of success.
The court also ruled that Qatar’s Civil Aviation Authority is a “foreign state” on which Australian laws do not apply.
However, an entire bench of the court today allowed Qatar Airways to continue the case, saying that the case was complex and it was not appropriate to reject it in the initial stage.
On which today, the Federal Court of Australia initially dismissed the decision to dismiss the case.
The court said in its judgment that deciding whether the claims are under the purview of the Montreal Convention, there is a complex case, so the case is not able to dismiss the case.
The court has also ordered Qatar Airways and peas to pay the cost of the appeal.
The lawyer of the affected women, Demian Storeskar said: “Our customers have faced a painful experience in Doha that night, and they deserve justice. They should be given the right to follow their case in court so that they can overcome this torture.
It should be remembered that in October 2020, a newborn baby was found from the toilet at Hamad International Airport in Doha.
Subsequently, women of ten separate flights, including 13 Australian citizens, were prevented to find and some were allegedly forced to take off their clothes and take medical examination.
Qatari officials were removed from the aircraft and took them to an ambulance parked on the runway, where a nurse took a personal examination. Some women said that they were also reduced.
